The Government of Ontario has introduced a new Employment Standard, which mandates that all temporary help agencies and recruiters operating in Ontario must be licensed, effective January 1st, 2024. This requirement extends the provisions of the Working for Workers Act, 2021, which includes safeguards for foreign nationals recruited to work in Ontario. The application phase for licensing became available on July 1st, 2023, and mandatory licensing will come into effect on January 1st, 2024.
According to the government’s definition, a “recruiter” encompasses any individual or organization that endeavours to connect potential candidates with employment opportunities in Ontario while charging a fee. A “temporary help agency” is described as an employer that temporarily outsources its employees’ services to clients, excluding employers who recruit staff for their own organization.
